In this cartoon the police officer asks the man to see his immigration
papers because his activity of cutting the grass is suspicion. This is a really
political cartoon because the state of Arizona passed a law giving police
officers probable cause to ask for a person’s immigration papers based on
racial profiling. The activity the man is displaying in this cartoon is
constant with the stereotype that ill-legal Mexican immigrants get jobs cutting
grass in America. This cartoon is
related to the 4th amendment because the Supreme Court ruled that
any form of racial profiling is unconstitutional. Therefore, the police officer
had no right and no probable cause to ask the Latino gardener for his papers.
This article is mostly about the
why the strip- search of a 13 year old girl was considered unconstitutional.
The Supreme Court upheld that a school search is reasonable and constitutional
if it is reasonable at its inception and if the search is within the scope. And
in the case of the search in question it was not reasonable at inception, nor
within the scope, therefore the search was deemed a violation of the 13 year
old girl’s 4th amendment’s rights. This article clear relates to the
4th amendment because it refers to the rights of students while in
school to be unreasonable searched. While in school students have less rights
than if they were outside of school, however the searches most still have
probable cause and be within the scope of what they are looking for.
